II. Goods and condition
1. The Merchant primarily sells new and used clothing, footwear, equipment and accessories for airsoft, historical reenactment, film and audiovisual productions and related activities. Additional products include historical and collectible items, period originals, reproductions and warehouse stock.
2. The properties, condition and price of each item are specified in its product listing. Unused long-stored items may show signs of age and storage; used items may show signs of prior use. Known material defects are disclosed in the listing.
3. Any deviation from statutory objective conformity requirements requires specific notice and the consumer’s express, separate acceptance at contract conclusion. Suitability of historical or warehouse items for intensive sporting use depends on the declared characteristics and agreed purpose.
III. Orders and contract formation
1. Customers may review and correct order details before submission. Submitting an order constitutes an offer; a contract is concluded when the Merchant electronically communicates acceptance. An automated technical acknowledgement is not acceptance unless its content clearly states otherwise.
2. The Merchant need not accept every offer. Any payment received for an unaccepted order will be refunded without undue delay.
3. Statutorily required contract confirmation is provided on a durable medium, usually by email. An invoice may form part of that communication if the legal requirements are met.
IV. Prices and payments
1. Product prices are shown in listings. Shipping costs and other Merchant-charged fees are disclosed before the order is submitted. Available payment and delivery methods are shown at checkout.
2. Deliveries outside the European Union may incur import duties, taxes, customs, administrative and other charges in the destination country. Unless expressly stated otherwise, such charges are not included in product or shipping prices and are borne by the buyer under applicable law and agreed delivery terms. The Merchant does not pay them unless required by law or express agreement.
3. For advance payments, the Merchant need not dispatch goods before payment is received.
V. Delivery
1. Goods are delivered using the selected method within the agreed period, or otherwise the statutory period. The buyer must reasonably cooperate with delivery. Risk of accidental loss or damage passes to the consumer in accordance with the Slovak Civil Code, generally upon receipt.
VI. Uncollected shipments
1. Failure to collect a shipment does not itself constitute withdrawal. Where the buyer breaches contractual duties, the Merchant may pursue statutory remedies, including proven damages where legal conditions are met.
VII. Withdrawal from the contract
1. For distance purchases of goods, consumers may generally withdraw without giving reasons within 14 days of receipt, subject to statutory rules for separate deliveries and parts.
2. Withdrawal may be communicated by an unequivocal statement to r.a.s.primarymail@gmail.com, by post or through the shop’s applicable online withdrawal function. Use of the model form is optional. Sending the notice by the final day preserves the deadline.
3. Statutory exceptions apply, including certain made-to-order goods. Used, historical or warehouse-stock status alone does not remove withdrawal rights.
4. Goods must be returned within 14 days of withdrawal. Direct return shipping costs are borne by the consumer unless law provides otherwise. Consumers are liable, under statutory conditions, for diminished value caused by handling beyond what is necessary to inspect the goods.
5. The Merchant refunds payments within the statutory period, including the cost of the least expensive standard original delivery. The Merchant may await return of goods or proof of dispatch, whichever occurs first, unless law provides otherwise. Procedures and form are in “Returns of goods and complaints”.
VIII. Liability for defects
1. The Merchant is liable for defects under the Slovak Civil Code; for new goods this generally covers defects existing at delivery that become apparent within two years. For used goods a shorter period, not less than one year, may be validly agreed. The age of unused warehouse stock does not itself shorten the period.
2. Following the first repair of a defect, the liability period is extended by 12 months, once only, as provided by law.
3. The liability period is not a guarantee of unlimited service life or freedom from wear. The Merchant is not liable for post-delivery mechanical damage, excessive stress, misuse, improper care or ordinary wear, unless the damage manifests a defect for which the Merchant is legally liable.
4. Damage to seams, buttons, zips, buckles and fabric is assessed individually according to the item’s nature, declared purpose and circumstances. Statutory burden-of-proof rules remain applicable. Defects must be notified within two months of discovery and no later than the statutory or validly agreed liability period. Procedures appear in “Returns of goods and complaints”.
IX. Alternative dispute resolution
1. Consumers may request a remedy if they believe their rights were breached. If the Merchant rejects the request or does not respond within 30 days after it is sent, consumers may seek alternative dispute resolution subject to statutory conditions. The Slovak Trade Inspection or another authorised body may be competent. Information: https://www.soi.sk/ and https://www.economy.gov.sk/.
X. Final provisions
1. These Terms apply to contracts concluded while they are effective. Amendments do not retroactively affect existing contracts without a legal basis or agreement. Invalidity of a provision does not affect the remainder to the extent permitted by law.
2. These Terms take effect upon posting on the website 01/01/2026.
